When contracts go wrong, it is best to address the conflicts early -- before the emotion builds up.
You need Dispute Resolution.
Mediation is when both parties agree that facilitated discussions may lead to early resolution of differences at least cost and minimum impact on management and professional time. Mediation will often allow the parties to continue to have a mutually valuable relationship.
So take your disputes to a specialist as early as possible.
In Mediation, the parties bring to the table expectations:
Of the mediator as an agent of reality;
Of agreements which are feasible, realistic, enforceable, sustainable and possibly fair.
In mediation the mediator works will both parties in open sessions and in closed sessions with each party - "caucuses" - and tries to get each party to see a solution to the problems.
He tries to find what the real conflicts are - where the emotion cuts in.
He tries to tease out various solutions.
He tries to ensure that the parties both see what the consequences of escalating the dispute will be.
And tries to get agreement.
On success he may help get a "going forward" agreement in place.
And at least cost.
